Terms and Conditions

The following terms and conditions apply to all relations between Bleu Carmin design, a limited company with a capital of 6000 €, located at 20 rue Lamartine 75009 Paris and registered in the Trade and Companies Register of Paris under the trading licence N° 822367314, N° TVA FR74822367314, and clients of www.bleucarmin-design.fr. Prior to any transaction, the customer acknowledges having read these general terms and conditions and expressly accepts them when clicking on the "Order" button.

Article 1:

Article 1: Special conditions of sale

The customer acknowledges having read, at the time of placing the order, the special conditions of sale stated online (name, price, quantity, colour, product description and cost of services) and expressly accepts them without reservation.

Article 2: Order validity

The items for sale on www.bleucarmin-design.com are exclusively for purchase by individuals.

Article 3: Order registration and confirmation

Bleu Carmin design confirms receipt of orders by email.

However, the sale will not be completed until the order is confirmed by Bleu Carmin design, in an email, which will be sent to the customer no later than three working days after submitting the order.

Bleu Carmin design reserves the right not to confirm an order for any reason whatsoever, whether it be due to the availability of products, a problem regarding the order received, an unusual order, a foreseeable problem concerning delivery, or a dispute relating to a previous order. In this case, Bleu Carmin design will inform the customer no later than 5 working days after the order has been placed, and will refund the customer without delay.

If one of the products included in an order is unavailable, the rest of the order will still be shipped.

Article 4: Price

The price is expressed in Euros and includes all taxes. The price indicated in the product descriptions does not include transport. Bleu Carmin Design reserves the right to modify its prices at any time but will not change prices from the moment the order is placed, subject to the product’s availability on that date.

Article 5: Payment and Security

The sole method of payment is by credit card on a secure banking server.

Credit card details are encrypted using SSL (Secure Socket Layer) and never pass unencrypted over the network. Payment is made directly to Crédit Mutuel. Bleu Carmin design has no access to these details, and does not keep them on its servers. If you encounter any problems, please contact us at contact@bleucarmin.com.

Article 6: Ownership

The products remain the property of Bleu Carmin Design until full payment of the order has been received.

Article 7: Delivery

Place of delivery: In principle, products will be delivered after the Order has been placed and paid, to the delivery address indicated by the customer when placing of the Order.

Preparation and delivery costs: The costs (VAT included) of processing, preparing and shipping orders will be communicated to the customer before the order is submitted.

Place of delivery: A delivery is considered complete as soon as the product is delivered to the address indicated by the customer at the moment the order is placed.

Withdrawal of products in the event of absence: In the event of the recipient's absence at the moment of delivery, the carrier will leave a calling card. Depending on the carrier used by Bleu Carmin Design, the customer will then either have to pick up or collect their products at the address according to the terms indicated by the carrier, or contact the carrier to agree on another delivery date. If the items are not collected within the time limits set by the carrier, the products will be returned to Bleu Carmin Design. The cost of the order may be reimbursed to the customer, but the shipping costs remain the responsibility of the customer. The order will be shipped within 3 working days. The ordered product is shipped by post (Colissimo) to the delivery address indicated by the customer.

Delivery conditions: The transfer of risk occurs upon delivery, when the products are handed over to the delivery address indicated by the customer, or when the products are collected from the carrier. Without compromising the customer's returns period, upon receipt of the products, it is up to the customer or the recipient to ensure that the products delivered correspond to his order, and to check the condition and conformity of products in relation to the order placed. If, during delivery, the exterior of the package is damaged, the customer or the recipient of the products will open the package in the presence of the carrier in order to check the condition of the products. In the event of damage resulting from transport, the customer must refuse the damaged products and indicate "refusal for damage". Without prejudice to the guarantees from which the customer benefits under article 8, for any complaint relating to an apparent defect or damage during delivery of the product, the customer must contact Bleu Carmin Design without delay. In order both to preserve the rights of Bleu Carmin Designs in relation to the carrier, and in the event that the product is still in the possession of the customer, initiate the return procedure in the conditions provided for in article 8. In the event of a refusal of the delivery or return of the product for the reasons referred to in the previous paragraph, the customer may request a new delivery or the cancellation of the order. The customer has 14 days to return the package. For any refund request, we will credit your bank account with the amount of the returned item. The return costs, however, remain the responsibility of the customer.

Article 8: Right of withdrawal

Any customer who acts for purposes that do not fall within the scope of his commercial, industrial, craft or liberal activity, and who is not satisfied with the products ordered, is entitled to exercise his right of withdrawal, without penalties, in the best conditions.

In accordance with the legal provisions in force, the legal period for the right of withdrawal is 14 full days from the day following physical receipt of the product, or receipt of the last product in the event of an order for several products. If this period of 14 full days expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.

The customer that exercises his right of withdrawal and returns a product is entitled to a refund of the price of the products ordered. If the right of withdrawal is applied to only part of the order, only the price invoiced for the returned products will be refunded.

For any refund request, after receipt of the product within 14 days by Bleu Carmin Design, we will credit your bank account for the amount of the returned item. The return costs however remain the responsibility of the customer and will not be refunded to you. Sale or discount items may be subject to a credit or an exchange.

To exercise this right of withdrawal, the customer must notify Bleu Carmin Design of its decision to withdraw by a letter or email to the address contact@bleucarmin.comclearly stating the reason for return. Here follows a recommended template. A withdrawal form is also available in your customer area once logged in.

This letter of withdrawal must be sent to Bleu Carmin Design, 20 rue LAMARTINE, 75009 Paris. However, the package including the return of your product must be sent to the following address: SERVIA, 16 rue Paul Henri Spaak - 77400 Saint-Thibault-des-Vignes, France.

Bleu Carmin design will send you an acknowledgment of receipt to confirm that your request for withdrawal has been taken into account.

Only the return or exchange of products in their original packaging, complete (accessories, instructions, etc.), in perfect condition for resale, (not soiled or damaged) will be accepted. The customer's responsibility is only engaged if the product is degraded when being handled after opening the packaging to establish its nature, characteristics and working order.

The cost of returning the product remains the responsibility of the customer, except in the event of non-conformity or proven hidden defects.

Return procedure

Products that the customer considers non-compliant or defective must be returned to the following address: SERVIA, 16 rue Paul Henri Spaak - 77400 Saint-Thibault-des-Vignes, France.

The customer must first contact Bleu Carmin Design by means of a letter sent by post or an email to contact@bleucarmin.com indicating the defect or non-conformity observed, accompanied with a photo illustrating the said defect.

The products must be returned in their original packaging and properly protected. They must be in perfect condition, apart from the identified fault or non-conformity. Any product that is returned incomplete, damaged, washed, deteriorated, soiled, even partially, will not be refunded or exchanged.

The customer returns the products indicating the defect or lack of conformity noted. We recommend that you keep proof of the return to facilitate procedures in the event of a problem occurring during transport.

 

Consumer dispute mediation system

In accordance with art. L221-11 of the Consumer Code, any dispute of a contractual nature relating to the execution of the sales contract and / or the provision of services that could not be resolved within the framework of a previously submitted complaint with our customer service, the Consumer may resort to mediation free of charge. The customer will contact the National Association of Mediators (ANM) either by mail by writing to 62 rue Tiquetonne 75002 PARIS or by e-mail by filling out the online referral form at the following address www.anm-conso.com.

 

The consumer can also visit the site of the European platform for online dispute resolution.

The following website www.economie.gouv.fr/mediation-conso also contains useful information in the event of a cross-border dispute.

 

Article 9: Provisions of the “data protection act"

Bleu Carmin Design has declared all personal data relating to customers of the site www.bleucarmin-design.fr to the Commission Nationale Informatique et Libertés (declaration No. 2008437) in accordance with the provisions of the Data Protection Act of January 6, 1978. Under this law, the customer has the right to access, rectify or oppose personal data collected. These rights can be exercised by e-mail at contact@bleucarmin.com

 

Article 10: Intellectual property

The customer is prohibited from copying or downloading all or part of the content of the site www.bleucarmin-design.com without the prior and express authorisation of Bleu Carmin Design, which remains the sole owner of all intellectual property rights therein.

Article 11: applicable law

These general conditions of sale are subject to French law.
